    (a)  The Contractor is responsible for ensuring that supplies 
are fabricated/manufactured to and meet all technical requirements 
for the items cited in the contract purchase identification 
description.  The Government reserves the right to conduct Product 
Verification Testing (PVT) at a Government designated test facility 
to ascertain if any or all of the item technical requirements are 
met prior to final product acceptance.  PVT will be required as 
determined by the Procuring Contracting Officer (PCO).  PVT will 
consist of material and/or mechanical/dimensional conformance 
inspections and tests as the Government deems necessary.

    (b)  When PVT is a requirement, the Contractor shall notify 
the PCO and the Quality Assurance Representative (QAR) in writing 
at least 30 calendar days before anticipated completion of manufacture 
of the contract quantity or first manufacturing lot.  This is to 
allow for sufficient time for scheduling and PCO coordination with 
the Government test facility.

    (c)  Where origin inspection is specified, the Contractor agrees 
to make available, at the Government's request, at the manufacturing 
facility, subcontracting facility, and/or final point of inspection, 
the quantity selected by the QAR to verify that the entire lot tendered 
meets the requirements of the contract.  The QAR will randomly select 
a specified sample size from the production lot.  This production lot 
will have been previously subjected to and passed all contractor and 
Government QAR inspections and tests.  The PVT samples shall be shipped 
by the Government at Government expense to the designated Government 
test facility as specified in the contract.  The PVT samples shall 
be shipped with a copy of the DD Form 250, a DD Form 1222 (as prepared 
in coordination with the QAR) and marked  "PRODUCT TEST VERIFICATION 
SAMPLES, Contract No.              , Lot/Item No.          ."  Upon 
shipment of the PVT samples, the original unsigned DD Form 250, along 
with a copy of the DD Form 1222, shall be submitted to the PCO.

    (d)     (This subparagraph pertains only to contracts and bilateral 
purchase orders.)

         (1)  The PCO will notify the Contractor of the results of the 
testing within 15 working days after receipt of the PVT samples by the 
Government test facility.  If the Government fails to act within the 
period set forth herein for notification, the PCO shall, upon timely 
written request of the Contractor, equitably adjust , under the Changes 
Clause of the contract, the delivery or performance dates and/or the 
contract price and any other contractual term affected by the delay.  
The Government is not required to accept/reject the supplies tendered 
until after receipt of the PVT results.

         (2)  The Government shall have the option to require the 
contractor to screen the entire production lot for any defects noted 
by the PVT.  Any defects so found shall be corrected before submitting 
the production lot for final acceptance by the Government.  The Government 
may also subject this production lot to further PVT.  If the Government 
disapproves the lot tendered for acceptance because of failure to pass 
the PVT, the Contractor shall be deemed to have failed to make delivery 
within the provisions of the default clause of the contract.  In such 
case, the Government reserves all rights and remedies to which it is 
otherwise entitled by law, regulation, or the contract.

    (e)  (This subparagraph pertains only to unilateral purchase orders)

         (1)  The PCO will notify the contractor of the results of the 
testing within 15 working days after receipt of the PVT samples by the 
Government test activity.  If the Government fails to act within the 
specified time period set forth herein for notification, the PCO shall, 
upon timely written request from the Contractor, incorporate FAR Clause 
52.243-1, "Changes-Fixed Price", into the purchase order and equitably 
adjust the delivery or performance date and/or the price and any other 
terms affected by the delay.  The Government is not required to accept/
reject the supplies tendered until after receipt of the PVT results.

         (2)  The Government shall have the option to require the 
Contractor to screen the entire production lot for any defects noted by 
the PVT.  Any defects found shall be corrected before submitting the lot 
for final acceptance by the Government.  The Government may also subject 
the production lot to additional PVT.  If the Government disapproves the 
production lot tendered for acceptance because failure to pass the PVT, 
the Government has the right to reject the entire offer, thereby releasing 
the parties from further obligations under the purchase order.

    (f)  In the event that the Government test activity performs 
destructive testing on any of the PVT samples, the Contractor shall 
receive the full contract unit price for that sample or samples as long 
as the testing found that sample or samples to be in conformance with 
technical requirements. 

    (g)  PVT samples determined to be conforming and not destroyed or 
degraded in testing shall be returned by the Government test activity to 
the contractor at Government expense.  The Contractor shall examine the 
returned PVT samples, refurbish as necessary, and may include them in the 
production quantity if found to be unharmed by the PVT.

    (h)  The PCO may waive the requirement for PVT where supplies being 
offered are identical to supplies that were accepted by the Government 
within a period of two years prior to the date of current solicitation.  
Offerors offering such products, who wish to rely on such prior 
acceptance by the Government, must furnish evidence with the offer 
that prior Government acceptance is presently appropriate for the 
products to be furnished hereunder by indicating below the information 
for identical supplies accepted by the Government.  In all cases, the 
PCO reserves the right to make final waiver determination.

The contract delivery schedule shall be reduced by 30 calendar days (time
allotted for submission and approval of PVT sample(s)) if submission of 
PVT sample(s) is waived by the Government.
